I am a single mother with 3 young boys who were recently taken from me by the state of Indiana, at which time I had lost my job through no fault of my own. Also the court had ordered me to pay child support to the state while they were wards of the state, at which time I had filed a petition to modify the child support due to no job (job went to China). As of December 21st 2006 I have had my children back in my home (meaning the state placed them back with me from foster care) but they are still making me pay child support. My question is how do I get them to stop the child support order due to the fact I am sole provider of my children and living only on unemployment weekly benefit, barely able whatsoever to provide them with the neccessities after I make the weekly child support payments to the county court house? My child support case was set up in CA. Then my ex wife moved to AL. She applied for AL child support. My ex say I owe back child support. Child support is garnished from my paychecks so I provided NC with copies to prove that I have paid. Months later AL is still sending me letters stating I owe back support. My ex wants to voluntarily sign over his rights if I stipulate that by doing so he is no longer responsible for child support. I will not cut off contact as I feel it is important she still sees her dad even though he has court ordered supervised visits as of now. If I do not sign the birth certificate or a paternity agreement, do not take a paternity test, and she does not pursue child support through the courts can the woman years later hold me liable for child support from the date of the birth? I live in Colorado and my Ex has filed a Modification of Child Support and Maintenance back in April of 06 and our Court date is Feb 5th 2007. He filed it because he was fired for reasons unknown from being a Network Engineer making 90,000 a year and is now claiming to be self employed installing windows on houses. Well my question is how can I make sure that his income will be imputed and will the Judge make me pay him back the difference in child support and pay back the maintenance from when he filed the motion if the Judge lets him get away with making 2 a hour now compared to 90,000 a year just because he has letters from his Doctors and is a disabled Veteran?
