My daughter is a foster-to-adopt parent of a now 19-month-old whose unmarried parents are unwed and meth addicted. The court just today terminated the father’s services and the next hearing date in a few months is to consider termination of his parental rights. He’s been denied paternity of the boy until required to take the appropriate test and has only seen him once, although he claims DCFS hasn’t returned his calls, during the time. He has relapsed and disappeared for periods of time, has no full-time employment at this time and no stable home.
I live in Indiana and my son’s biological father has not been in the picture. He did not help during the pregnancy, nor attempt to get a DNA test.

After my baby was born, I called him and he rented a house for us in a bad neighborhood while he bought some land and started building a house. We were only together 3 months. We had a couple of arguments about where we lived and other things and then I threatened to leave and take his son to New York with me. He has slapped me and we have had other fights as well. I told him I’m leaving and he will never see his son again. I left him and he found out I as in a close by city. I found someone new and let him adopt my son without telling my son’s father. He now says he is going to sue me. Can he sue me and my new husband?
I am 25-years-old and I currently care for my little brother who is 8-years-old. Our father has been incarcerated and his mother gave up her legal rights as a parent. My father’s rights have also been taken away. Our older brother adopted him to avoid my younger brother from being put into the foster care system. Our older brother however does not have the lifestyle to care for my younger brother (works odd hours, no help for pick up drop off, no interest in extracurricular activities). So for the last 3 years, my brother has been in my care. I have registered him for school, taken him to medical appointments, parent teacher conferences, karate, and everything in between. Our older brother gets a stipend from the state for adopting him and sometimes he gives it to me or sometimes he keeps it. He always claims my younger brother on his taxes and I believe that this is the main reason why he won’t relinquish his custody of my brother. My older brother provides no outside financial support, he never spends time with him, or even calls to check up on him. I have two other children and I am in the Air Force Reserves. My fiancee also works. My question is, how do I go about gaining custody of my little brother? Do you believe I have a good case/chance?
