Note: The DearEsq free 'ask a lawyer' site is offered as a free informational service to the public and is not intended as legal advice. Laws vary from state-to-state, and in addition every situation is unique, and relevant facts may not be known. The answer to the question posed below may not apply to in your state or to your situation. For legal advice in your state and your situation you should consult with an attorney in your state who is familiar with the rules and laws in your state.

“I need to supoena the video tape from a state trooper’s patrol car during the time I was ticketed. The alleged Infractions were in a construction zone so the patrol car’s lights were constantly on which is the trigger for the video to begin recording. I face two serious tickets in NJ and I’m sure the video would back up my story and not the officers. The traffic court judge told me his court can only supoena witnesses not evidence such as this. I’m totally lost as to how to get this video.”

Question: This will vary from location to location; you need to consult with a criminal law attorney in your area – they should know exactly what you need to do to get a copy of that tape.
