My Attorney will not Finalize my Bankruptcy Until all Legal Fees are Paid, Is this Legal?
I recently hired an attorney to file for chapter 7 bankruptcy. I was told up front that the bankruptcy would not be final until all fees were paid. My attorney says that he won’t do anything until all fees are paid in full. I have paid him $700.00 of a $1300 total. Is this reasonable normal practice? My brother and I both have our names on my grandfather’s home, but he has lifetime conservatorship. If I file bankruptcy, can my creditors do anything with that property? Also, if he passed away within a few months of filing bankruptcy, can the creditors do anything with my brother’s half of the inheritance? I filed bankruptcy in Sept.2006. I just heard from the trustee that I have to sign over my tax return ( if any) over to him, and that this would not be put towards the balance of my debt. I do not understand how he can take my refund legally? I live in Missouri. I cosigned for my 18- or 19-year-old son to get a credit card somewhere around 1999 or 2000. He filed bankruptcy, and now they are coming after me. Can they take my Social Security disability check? I have been told by several people that disability income can not be garnished; however, I don’t know if that is really true. Is it? Can I file for bankruptcy without involving my spouse? Bankruptcy can be a way to obtain debt relief from crushing credit card debt and other debts, but it should not be entered into lightly.
