What are Rights of Father in New York on SSI Benefits?

“My son receives SSI benefits in the State of New York.  What are his rights, regarding visitation when not seeking custody?   He also has earnings from his job and reports this to SSI.  Will he then be responsible to pay child support by having his wages garnished?”

There are statutory requirements in New York that calculate what, if anything, he would be required to contribute for support.  The Court’s purpose is to keep both parents involved and make sure the child has everything he or she needs.  It would be best if he and the mother could work out a visitation schedule outside of court.  So even though your son is not seeking custody, he can still petition the Court if he and the mother cannot work out a visitation schedule.
