Note: The DearEsq free 'ask a lawyer' site is offered as a free informational service to the public and is not intended as legal advice. Laws vary from state-to-state, and in addition every situation is unique, and relevant facts may not be known. The answer to the question posed below may not apply to in your state or to your situation. For legal advice in your state and your situation you should consult with an attorney in your state who is familiar with the rules and laws in your state.

I have 3 1/2 acres of land. I have had it for 10 years. The owner on the west side cuts wood for a business. He continually keeps moving more and more onto my land, at one time even removing small saplings. I did not want to have issues with my neighbor but it has gotten to the point where I need to. He has even put a posted sign, right next to the cement post that marks the line only, which it is on my side of the line. What rights do I have in this case?

Your neighbor is trespassing on your land and stealing your property (trees). That can be prosecuted both civilly and criminally. I suggest you talk to an attorney experienced in real estate matters about your options (and the potential reaction to them).
