My great grandparents bought some town lots in 1906 at a town site in Texas that doesn’t exist anymore. It was near a salt and alkaline lake. My grandmother, then my mother, and now I, am paying taxes on it. No one has ever offered to buy these lots in a hundred years. Last July someone did and was trying to buy the lots of other descendants of the original settlers. For the legal part.
My father had a Last Will and Testament but my mother did not file it for probate after his death in 1999. This was not ignorance of the law on my mother’s part, but rather greed. Her non-filing of my father’s Will has caused a terrific amount of pain I can’t begin to describe. My attorney fees are pushing 0,000 and I’m being sued by my mother, my mother’s daughter from a previous marriage (legally adopted by my father), my only sister, my father’s daughter from his first marriage and my father’s son from his first marriage. His estate was not substantial but the conditions concerning his Will have been lost to the laws of intestate.
When my parents drew up their mutual will, my oldest brother lived in a different state and I was planning to move also. Because of this, they appointed my youngest brother as executor; I believe he was also appointed their power-of-attorney. First, he urged my parents to turn over all their real estate so my oldest brother so I would not benefit from it.
My husband is planning to write his last will testament stating that, at the time of his death, his body will be buried in the Philippines and that he is giving me all the rights and authority to claim his pension, Social Security and whatever other claims there may be. Were living in Waltham, MA. USA. Do we have to notarize it or is it acceptable as long as it is his handwriting.
I was under the impression that my grandmother had changed her will shortly before her death. In the Information to Heirs and Devisees’ letter it states ‘the decedent’s will dated -a year ago- and codicil dated N/A was presented’. Does that mean there were no changes made? Or that the ‘amendment’ was not accepted or something?
I live with my father, my mother died almost two years ago and their joint will states that in the event of my fathers death, all monies and property is left to me. My father has now asked my mothers sister to move into the property, what are her rights as to tenancy and claiming half the properties value?
What rights do I have to my dad’s estate? I never met him and he was a police officer who died in 2004. He was married to a second wife and had a son from that marriage. He also had a son with anther woman prior to getting married. The woman he married had a daughter who was not my dad’s. His wife passed on in 2006. When I went looking for him at the police station at which he used to work, I found out that he had died and that some of his money had been left for his beneficiaries, which they need to claim.
This property is in Lee County Alabama. My sister was named the executor and has moved onto the property despite the will stating to sell, divide share equally, per stripes. She’s declaring that since I have not paid toward a 00 yearly property tax bill that I am not entitled to my portion of the inheritance. Is she just blowing smoke, or will I ultimately be entitled to my portion.
Property in the State of Missouri was deeded to sons one year before father’s remarriage using a general warranty deed. Now the widow wants the property. Can she do this? She owns two other homes from other marriages and one from the marriage to the sons’ father so she does not need these properties to live on.
