I am married and have three children from my ex-husband. My husband has been taking care of me and the children for over 9 years (we live in Georgia). I am thinking of getting a divorce. I have never gotten any money from my ex-husband, he is disabled and could not pay.
Once my wife found out that I was having another baby and was engaged to be married she tried to go after me for child support, which I had been paying her directly for the last 10 years, but she also filed for alimony. I just made a physical appearance at our last court hearing this week and when I showed up, low and behold my soon to be ex-wife looks to be about 6 months pregnant, and this was confirmed by her attorney.
My ex-wife is trying to get her spousal support extended even though she is capable of working. She is also trying to get me to pay her additional child support as back support, even though I paid that child support – directly to our son who was 18 at the time. I will never be able to purchase a home or have any type of comfortable life-style if I am forced to care for her indefinitely! Do you think a judge would grant her what she is requesting?
The alimony law in most states bases alimony (also called maintenance) on the need, the relative financial position, and the lifestyle attendant to each spouse.
I have been contemplating moving out of Florida, but a friend tells me that the alimony will be stopped if I move, is this true?
