Can I Hold My Neighbor Liable for Damaging My Property?

Note: The DearEsq free 'ask a lawyer' site is offered as a free informational service to the public and is not intended as legal advice. Laws vary from state-to-state, and in addition every situation is unique, and relevant facts may not be known. The answer to the question posed below may not apply to in your state or to your situation. For legal advice in your state and your situation you should consult with an attorney in your state who is familiar with the rules and laws in your state.

My neighbor has a very large tree in her yard and she has allowed the tree roots to spread under my carport causing it to bulge and tilt to one side. What can I do to get her to pay damages to my carport. The roots from her tree are running into my waterline also causing problems with backups.

You will need to check the laws in your area, but generally if a tree belongs to one neighbor, that person is responsible for damage caused by it. You should try talking with your neighbor first, to see if you can work out an agreement, but failing that I would recommend you speak with a local real estate attorney, who can go over all your options.
