Does My Husband Need a Lawyer to Adopt my Child?

Note: The DearEsq free 'ask a lawyer' site is offered as a free informational service to the public and is not intended as legal advice. Laws vary from state-to-state, and in addition every situation is unique, and relevant facts may not be known. The answer to the question posed below may not apply to in your state or to your situation. For legal advice in your state and your situation you should consult with an attorney in your state who is familiar with the rules and laws in your state.

“My husband have been with me and my son for a long time and my husband wants to adopt my son is their a way he can file for adoption without having to get a lawyer or pay all that money people said it is for adoption?? How can we start these process we need help on how to start working on these???”

Question: The rules for adoption proceedings vary by state. Almost every state would require the filing a petition for the adoption with a juvenile court. You will likely need biological father’s consent or some other work around. I do not have a specific do it yourself adoption kit to recommend, or particular state resource, but they are out there. Some attorneys and/or adoption services agencies may give a free consultation. There are libraries in your community and on line. Either start researching or start saving to hire an attorney.
