Do I Have to Move My Shed Off Of My Neighbor’s Property?

I have a shed that is 5 feet on the neighbor’s property. The neighbor that lived there 2 years ago gave us permission to put it there. Now we have a new neighbor and they tell us we need to move the shed. Do we or do we not need to move it?

Yes. Unless your old neighbor granted permission that is permanent — and that would usually be in the form of something recorded against the property — the permission you got can be revoked, and that’s what the new neighbor is doing.

You might be able to work out a new arrangement with the new neighbor, but unless the old neighbor tied their hands (and you have that in writing to prove it), they are completely within their rights to demand that you get your property off theirs.
