I bought a piece of property approximately 1.0 acres in a small private community and the road is not state maintained. My lot is at the bottom of the road. There are 8 house sites total on the hill. I am grading out for a house on my lot.
Who is responsible for damage to my walkway, driveway, garage floor and possibly the house foundation by a tree on my property put there over 50 years ago by the developer?
My builder told me that my lot had a greenbelt behind it so nothing would be built on that area. They charged extra for this lot as a premium lot. The greenbelt is actually a gas pipe with an easement that extends 25 feet onto my lot.

My husband and I have lived in our house for almost 13 years now. Before we bought our home we reviewed the survey and were aware that our neighbors fence was to their backyard which was 5 ft from the edge of our driveway and the edge of our driveway is the property line. The previous owners of our home put in a sprinkler system and there are 5 sprinkler heads and a valve box that are on the property that is technically our neighbors.
If I put up a fence on my property, does the homeowners association have the right to hire a surveyor and survey my property without my permission?
