Can the Homeowners Association Amend Existing Pets and Animals Out of the Property?

Note: The DearEsq free 'ask a lawyer' site is offered as a free informational service to the public and is not intended as legal advice. Laws vary from state-to-state, and in addition every situation is unique, and relevant facts may not be known. The answer to the question posed below may not apply to in your state or to your situation. For legal advice in your state and your situation you should consult with an attorney in your state who is familiar with the rules and laws in your state.

“The Home Owners Association of which I am a member is submitting for approval an amendment to the current Covenants which would proscribe the keeping of horses. Since horses were specifically allowed when I purchased my property and I have already invested in stalls and tack, do I have any legal recourse for an exception to the (new) restriction? Is there any relevant Georgia case law?”

Question: Unfortunately, this is such a specific situation, and specific to Georgia law, that you really need to consult with a Georgia attorney who specializes in Georgia property law in general, and homeowners associations in particular.
