My Child’s Father has a Warrant for Domestic Abuse, Would the Court Consider a Petition for me to have Sole Custody if the Abuse Happened to Someone Else?
We have one child together who will be 4 this December. We were never married, and he left to move across the country when our son was 4 days old and has had minimal contact with him since then. The court has ordered joint custody while giving me sole physical custody. I have now been contacted by his current girlfriend who is 8 months pregnant with twins fathered by him. She has just filed a domestic abuse charge against him because he came over and rough housed her and left bruises. If he is arrested, and when the charges proceed, what can I do about petitioning the court for Sole custody? Would the court even consider my petition if the abuse is happening elsewhere? We moved from Illinois about 5 years ago, have been married almost 17 years and my husband is having an affair with someone from Illinois. Last night he talked with the children (12, 14) about getting a divorce (I was attending an CoDepency Meeting), and my son (14) wants to go to Illinois with him. While I wouldn’t mind it , I don’t believe it’s a good idea for my son. 3 weeks ago my husband pushed me down in the driveway, I received 8 staples in my head, all because I was to ‘persistent’ in asking about the affair. I’m wondering what I need to do so my son isn’t shattered when they go to Illinois and live with her, being his age can I still maintain custody of him. I have Bipolar Disorder, and wrote some bad checks and used a credit card illegally. I was in jail for one month. Then went through a domestic violence with my husband who is now my Ex- husband. The father of my two children keeps getting my parenting rights suspended because, of all that has happened this past year. What should I do to regain at least some visitation rights? I’m working now and paying child support again also. I live in Louisiana, my grandchildren live in Florida. They are visiting for the Christmas Holiday and have told me some things that have concerned me. The children have spoken to Child Protection but the step mother always seems to clear the air so to speak. What can be done about this? They are to scared to say any more to any one due to the trouble they get in when they do. I do not know what my rights are I’m married 10 yrs 3 kids in a very abusive relationship. I want to get out of I was severely beaten and raped by an ex-boyfriend 3 months after the break up. The beating was so severe that I was in a coma for 4 days. He calls me names, and he calls me several times during the day and night even when I ask him to stop. What can I do? Hours after getting married, the groom assaulted the bride, and she left. Can she receive money for emotional distress in the divorce proceedings? When a non-married couple splits up and both people are on the lease, what can they do and what are their property rights? And when one of them threatens the other and pins them down, that meets the definition of domestic violence.
