Are Parties in a Lawsuit Legally Required to Provide All Evidence Prior to the Suit Being Filed?
Disclosure of parties pre-suit: Is there a legal principle, which obligates one party to provide relevant documentation, evidence, etc… requested by the other party before suit is filed? I’m not talking about discovery that happens after suit is filed. I am being sued by John Deere for a tractor which I had paid $17,000 back 4 years ago. The indvidial whom I purchased it from never paid off the tractor and filed Bankruptcy. John Deere has filed a civil action against me for the tractor. I was unaware of any title on tractors and never research it to see if there was ever a lien on the tractor. Do I have any legal recourse in this matter? What do you see the court’s decision to be on this? I filed for bankruptcy in 1999 and listed my child’s mother as well as other creditors under ch 7 (Chapter 7). I now have a court order to pay child support to her. We received a call from our attorney after the bankruptsy was finalized; telling us that we could now sell the inventory because the Trustee did not do anything with it. I cosigned for my 18- or 19-year-old son to get a credit card somewhere around 1999 or 2000. He filed bankruptcy, and now they are coming after me. Can they take my Social Security disability check? “I live in California, am married and in debt with credit cards. Can a wife file bankruptcy without her husband if he is not on any of the credit cards?” I have been told by several people that disability income can not be garnished; however, I don’t know if that is really true. Is it? Can I file for bankruptcy without involving my spouse?
